Introduction These terms and conditions ("Agreement") govern the use of services provided by Kiwis Autos Limited ("we," "us," or "our"). By accessing or using our services, you ("you" or "the customer") agree to be bound by these terms and conditions. If you do not agree to these terms, please refrain from using our services.

Services Provided

2.1 Description of Services

Kiwis Autos Limited offers a comprehensive range of automotive repair and maintenance services, including but not limited to general maintenance, repairs, detailing, tire services, wheel alignments, electrical diagnostics, air conditioning services, and more. 2.2 Pricing and Payment

The pricing for our services is provided on our website, and additional costs, if applicable, will be communicated to you before commencing the service. All prices are in New Zealand Dollars (NZD) and include any applicable taxes. Payment is due at the time of service completion, and we accept cash, debit cards, and major credit cards.

Appointment Booking, Cancellation, and No-shows

3.1 Appointment Scheduling

To utilize our services, you are required to schedule an appointment in advance. Appointments can be made through our website, by phone, or in person at our Auckland location

3.2 Cancellation and Rescheduling

If you need to cancel or reschedule your appointment, we kindly request that you notify us at least 24 hours in advance. Failure to provide timely notice may result in a cancellation fee of 50% of the service cost. However, we understand that unforeseen circumstances may arise, and we will work with you to find a suitable solution.

3.3 No-show Policy

If you fail to arrive for your scheduled appointment without prior notice ("no-show"), we reserve the right to charge a no-show fee equivalent to 100% of the service cost. Repeat no-shows may result in restrictions on future bookings.

Liability and Warranty

4.1 Limitation of Liability

Kiwis Autos shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with the use of our services, including but not limited to vehicle damage, loss of data, loss of profits, or personal injury. This limitation of liability applies to the fullest extent permitted by law.

4.2 Warranty

We provide a limited warranty on repairs and services in accordance with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. The specific warranty terms and coverage are outlined on our website and provided with your service documentation. Warranty claims require the original invoice and may require inspection by our technicians.

4.3 Issues Not Directly Caused by Kiwis Autos

Kiwis Autos shall not be held liable for any issues or damages that are not directly caused by our services or as a result of our direct fault. This includes but is not limited to, pre-existing vehicle conditions, manufacturer defects, or any issues unrelated to the specific services provided by Kiwis Autos. Customers are advised to refer to the relevant manufacturer warranties or seek appropriate advice for such issues.

4.4 Consumer Protection

These terms and conditions are intended to comply with the Consumer Guarantees Act 1993 and other relevant laws in New Zealand. Nothing in this Agreement shall limit or affect your rights as a consumer under these laws.

Intellectual Property content, trademarks, logos, and materials provided by Kiwis Autos Limited are protected by intellectual property laws. You agree not to use, reproduce, or distribute our intellectual property without our prior written consent.

Dispute Resolution

Any disputes arising from or relating to this Agreement or the use of our services shall be resolved through good-faith negotiations. If a resolution cannot be reached amicably, both parties agree to submit to the exclusive jurisdiction of the courts of New Zealand.

Modifications and Termination

Kiwis Autos reserves the right to modify or update these terms and conditions at any time. Any changes will be effective immediately upon posting the revised terms on our website. Continued use of our services after the posting of such changes constitutes your acceptance of the modified terms. We also reserve the right to terminate or suspend our services to any customer for any reason, including violation of these terms and conditions.

Severability

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
